Edie Feffer Health and Wellness LLC
These Program Terms ("Terms") govern participation in Safe Enough to Heal ("the Program") and membership in the online community in which the Program is delivered ("the Community"). The Program and the Community are provided by Edie Feffer Health and Wellness LLC, an Arizona limited liability company ("Practitioner").
These Terms take effect when a participant joins the Community ("Member") and remain in effect for as long as the Member has access to the Community. Sections 7, 8, 9, and 11 survive the end of that access.
The Program provides health coaching and education in Emotional Freedom Techniques ("EFT").
EFT is a complementary wellness service and not a licensed medical or psychological treatment. EFT is not currently regulated by any licensing board in the United States. Practitioner is not acting as a physician, psychologist, licensed dietitian, or mental health counselor, and does not diagnose, prescribe medication, or offer medical procedures.
The Program is not therapy, psychotherapy, medical care, or mental health treatment, and is not a substitute for any of them. Nothing in the Program diagnoses, treats, or cures any disease or condition.
Member is responsible for consulting a licensed medical or psychological professional for diagnosis or treatment of any medical condition. Member agrees not to change any treatment, medication, or care plan based on Program content without first consulting the provider responsible for that care.
If Member is currently working with a licensed mental health professional, Practitioner recommends that Member inform that provider of their participation in the Program.
Participation is voluntary. All tapping in the Program is self-administered following recorded guidance, and no physical contact occurs between Practitioner and Member. Member may pause, skip, or stop at any time without penalty or obligation.
The guided tapping videos are self-directed tools. They are not intended for processing highly charged or traumatic material alone. That work belongs in one-on-one care with a qualified practitioner or licensed mental health professional.
Member remains responsible for their own emotional, physical, and psychological well-being at all times, throughout and after the Program.
Member understands that EFT may surface previously unresolved memories or emotions, either during or after a practice. EFT has been widely used with no known serious side effects when properly administered, and these responses are a natural part of the process.
Member also understands that previously traumatic memories may lose their emotional charge, and that this could adversely affect Member's ability to provide legal testimony carrying the same impact as before the use of these techniques.
The Program and the Community are not monitored around the clock and are not a crisis service. A Member in crisis or concerned for their own safety should contact local emergency services or a crisis line immediately.
Practitioner reserves the right to take appropriate action, including contacting emergency services or relevant authorities, where there is clear indication that a Member poses a risk to themselves or to others. This includes, but is not limited to, situations where Practitioner suspects child abuse, elder abuse, or that a Member may cause harm to themselves or another person.
The Community is a space of kindness and mutual respect. Member agrees not to screenshot, copy, republish, or share any other Member's posts, stories, or personal information outside the Community. Member agrees to share personal experience rather than medical advice.
Confidentiality cannot be guaranteed in a group setting. Practitioner does not control what other Members do with information shared in the Community, and Member acknowledges this in deciding what to share.
Information a Member shares directly with Practitioner is held in confidence, except where disclosure is required by law, including risk of harm, suspected abuse, or court order.
The Community is hosted on a third-party platform that is not a HIPAA-compliant environment, and Practitioner is not a HIPAA-covered entity. Anything a Member chooses to post in the Community is shared voluntarily and is not treated as protected health information.
Practitioner is not bound by therapist-client privilege, and communications are not subject to the protection of any legally recognized privilege.
All Program materials, including videos, scripts, guides, and written content, are the protected intellectual property of Edie Feffer Health and Wellness LLC and are for Member's individual use only. Member agrees not to copy, distribute, reproduce, or sell Program content, scripts, worksheets, or methodologies.
Member confirms that they are 18 years of age or older.
Practitioner reserves the right to remove any Member whose conduct is disruptive, abusive, or harmful to the Community, or who breaches these Terms, at Practitioner's sole discretion and without notice or obligation.
Practitioner makes no guarantees regarding outcomes.
Member irrevocably releases and discharges Practitioner, together with its members, employees, contractors, agents, affiliates, and successors, from any and all claims, losses, demands, or damages arising from participation in the Program or the Community, whether known or unknown, present or future. This release is binding on Member and on Member's heirs, successors, assigns, and representatives.
Practitioner shall not be liable for any indirect, incidental, consequential, or special damages.
These Terms are governed by the laws of the State of Arizona. Any dispute that cannot be resolved by mutual agreement will first be submitted to mediation in Maricopa County, Arizona. If mediation does not resolve the dispute, it will be settled by binding arbitration in Maricopa County, Arizona, and the arbitrator's decision will be final and binding.
Practitioner may update these Terms. Continued participation in the Program or the Community after an update constitutes acceptance of the updated Terms.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
