Free Resource Terms

Edie Feffer Health and Wellness LLC

These Free Resource Terms ("Terms") govern the use of free guides, scripts, worksheets, and related emails (each a "Resource") provided by Edie Feffer Health and Wellness LLC, an Arizona limited liability company ("Practitioner"), including When You Can't Think Your Way Out and The Self-Trust Road Map. These Terms apply when a person signs up for or uses a Resource ("User").

1. Nature of the Resources

The Resources provide education in health coaching concepts, self-trust, and Emotional Freedom Techniques ("EFT"). EFT is a complementary wellness practice and not a licensed medical or psychological treatment. EFT is not currently regulated by any licensing board in the United States. Practitioner is not acting as a physician, psychologist, licensed dietitian, or mental health counselor, and does not diagnose, prescribe medication, or offer medical procedures. The Resources are not therapy, psychotherapy, medical care, or mental health treatment, and are not a substitute for any of them. Nothing in the Resources diagnoses, treats, or cures any disease or condition.

2. Continuing Care

User is responsible for consulting a licensed medical or psychological professional for diagnosis or treatment of any medical condition. User agrees not to change any treatment, medication, or care plan based on Resource content without first consulting the provider responsible for that care. If User is currently working with a licensed mental health professional, Practitioner recommends that User inform that provider of their use of the Resources.

3. Voluntary Use and User Responsibility

Use of the Resources is voluntary and self-directed. All tapping is self-administered. User may pause or stop at any time. The Resources are not intended for processing highly charged or traumatic material alone. That work belongs in one-on-one care with a qualified practitioner or licensed mental health professional. User remains responsible for their own emotional, physical, and psychological well-being at all times.

4. Emotional Material and Aftereffects

User understands that EFT may surface previously unresolved memories or emotions, either during or after a practice. EFT has been widely used with no known serious side effects when properly administered, and these responses are a natural part of the process. User also understands that previously traumatic memories may lose their emotional charge, and that this could adversely affect User's ability to provide legal testimony carrying the same impact as before the use of these techniques.

5. Not for Emergencies

The Resources and related emails are not a crisis service. A User in crisis or concerned for their own safety should contact local emergency services or a crisis line immediately.

6. Communications and Privacy

Signing up for a Resource adds User to Practitioner's email list. User may unsubscribe at any time using the link in any email. Information a User shares directly with Practitioner, such as by replying to an email, is held in confidence, except where disclosure is required by law, including risk of harm, suspected abuse, or court order. Practitioner is not a HIPAA-covered entity and is not bound by therapist-client privilege. Personal information is handled as described in Practitioner's Privacy Policy.

7. Resource Content

All Resources, including guides, scripts, worksheets, and written content, are the protected intellectual property of Edie Feffer Health and Wellness LLC and are for User's individual use only. User agrees not to copy, distribute, reproduce, or sell Resource content, scripts, worksheets, or methodologies.

8. Eligibility

User confirms that they are 18 years of age or older.

9. Release and Limitation of Liability

Practitioner makes no guarantees regarding outcomes. User irrevocably releases and discharges Practitioner, together with its members, employees, contractors, agents, affiliates, and successors, from any and all claims, losses, demands, or damages arising from use of the Resources, whether known or unknown, present or future. This release is binding on User and on User's heirs, successors, assigns, and representatives. Practitioner shall not be liable for any indirect, incidental, consequential, or special damages.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona. Any dispute that cannot be resolved by mutual agreement will first be submitted to mediation in Maricopa County, Arizona. If mediation does not resolve the dispute, it will be settled by binding arbitration in Maricopa County, Arizona, and the arbitrator's decision will be final and binding.

11. Changes to These Terms

Practitioner may update these Terms. Continued use of the Resources after an update constitutes acceptance of the updated Terms.

12. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
